1 – The EVTT PROVENCE company rents to the customer (tenant) the equipment as described in the
purchase order, serving as a rental contract (online reservation, telephone
or on site). This rental is granted to the present general conditions and to the
special conditions specified below that the customer accepts and undertakes to respect.
The order is considered firm upon receipt by the user of the mail
electronic confirmation of said order or signature of the contract on site. This
confirmation constitutes conclusion of the sales contract and acceptance by the user of the
these general conditions of sale, effective on the date of receipt of the contract.
2 – The Tenant declares that he is the holder of a civil liability insurance policy.
3 ‐ The Tenant declares to be able to drive the rented equipment and declares not to have any
medical contraindication.

4 – The rental contract is neither assignable nor transferable. The loan or sub‐letting of equipment rented by EVTT PROVENCE is strictly prohibited.
5‐ The rental takes effect when the tenant takes possession of the equipment and accessories delivered to him.
The risks (breakage, theft, degradation) will be transferred to the tenant, who will assume custody of them under his full responsibility, when the equipment and accessories are handed over. He undertook to use them in all circumstances as a good father.
6 – This contract is only in force for the duration of the rental as specified in the special conditions described in the order form. Any extension of the contract will be subject to the Lessor’s agreement.
7 – The Tenant acknowledges having received the rented equipment in good working order with the basic equipment. He declares that he personally had full latitude to check the equipment and choose it in accordance with his needs. In particular, the lessee acknowledges that he has been offered the rental of helmets corresponding to the rented cycles. Wearing a helmet by the renter is strongly recommended by the renter.
8 – The lessee undertakes to use the rented equipment with caution, without danger to third parties and in accordance with the regulations in force. The Tenant is personally liable for any traffic violation and is always liable for bodily injury and material damage caused by the use of the rented equipment (art. 1383 and 1384 of the civil code). The Lessor’s liability is expressly released in the event of non-compliance with the legal requirements.
9 ‐ Repairs, maintenance and replacement of parts or tires resulting from normal wear and tear are the responsibility of the Lessor. Repairs, maintenance and exchanges of parts or tires resulting from faults of the customer are the responsibility of the latter. The immobilization of the rented equipment necessary for its restoration will give rise to the payment by the tenant of an indemnity equal to the price of the rental of the equipment during its immobilization. Repairs made by a third party, other than the Lessor, will not be reimbursed. It is strictly forbidden for the tenant to modify the rented equipment.

10 – The rental price includes Breakage and Theft insurance taken out by the lessor with Tulip SAS. This insurance covers breakage and theft of bicycles under certain conditions.
Are covered:
-All accidental breakages of the bike
– Theft by assault / burglary
– The theft of the bicycle attached to a fixed point. The Tenant undertakes to hold the equipment hung on a fixed point of attachment by a lock outside periods of use, keeping the keys of the lock.
Are excluded from the warranty:
– Damage caused intentionally
– Non-fixed accessories (pump, meter, battery, etc.)
– Punctures and wear damage (e.g. broken brake cable, scratches)
– Non-compliance with the lessor’s instructions
In case of problem :
• Declaration directly to the lessor
• Breakage: Excess of 10% of the repair with a minimum of 10€
• Theft: Deductible of 10% of the value of the bike (A declaration to the police must be made within 24 hours)
11 ‐ In the event of non-compliance with one of the warranty conditions, the tenant is personally liable for damage, breakage and theft suffered by the rented equipment. However, the tenant cannot be held responsible for the consequences
damages of hidden defects of the rented equipment or wear and tear not apparent and unsuitable for the use for which it is intended, as soon as proof of the said defects or wear and tear can be provided by the Tenant. In case of breakage the tenant agrees to return the damaged equipment and it must be recognizable and complete. The damage suffered by the equipment will be invoiced to the tenant according to the tariff in force.

12 – When the rental company makes the equipment available, the rental company is asked to pay a deposit by credit card (between €200 and €1,000 depending on the value of the rented bike). This deposit will be returned to the tenant when the equipment is returned, after deducting any damage provided for above. The deposit cannot under any circumstances be used to cover an extension of the rental. The lessor
reserves the right to keep the deposit or the identity document placed on deposit in the event of a dispute.
13 ‐ The return of the rented equipment will be made at the time provided for in the contract
14- Customers who cancel within a minimum of 48 hours before the start of the activity will be fully refunded. Reservations within 48 hours are not refunded.

We reserve the right to charge 10% of the price for administrative costs in the event of cancellation more than 48 hours before the date and time at which the service is scheduled.
